Welcome to MyDailyPocket. This Site and the MyDailyPocket brand are operated by Elyvita Ltd (UIC: 208626481), a company registered in the Republic of Bulgaria, with its registered office at 1343 Sofia, Liulin, bl. 202, ent. B, floor 4, apt. 31, and represented by its director Stanislava Zlatkova ("we," "us," "our").

By accessing www.mydailypocket.com (the "Site") or buying our products, you agree to these Terms of Service. Please read them carefully.

1. Who can buy

You must be at least 18 years old to buy from us or hold an account. Several of our products are formulated for children (ages 4–11) and teenagers (ages 12–17), but they must be purchased by an adult. If you buy a product for a child in your care, you confirm you are responsible for deciding whether it is suitable for that child and for supervising its use. By ordering, you confirm the information you give us is accurate and complete.

2. Products and subscriptions

We sell food supplement powders on a subscription basis and also offer one-off purchases.

  • A subscription provides a recurring monthly supply (30 servings per pouch unless stated otherwise) at the price shown at checkout (currently €39.95 per 30-day pouch for the standard option).
  • Subscriptions renew automatically each month until you cancel or pause them.
  • You can manage, pause, or cancel your subscription at any time through your account or by emailing contacts@mydailypocket.com. Cancellation takes effect for the next billing cycle; the current cycle already paid for will still be delivered.
  • We may modify or discontinue products, giving notice where required.

3. Pricing and payment

  • Prices are shown in EUR and include VAT where applicable, in line with EU and Bulgarian tax rules.
  • Subscription payments are charged automatically each month to the payment method you provide. By subscribing, you authorise us to charge that method for each renewal until you cancel.
  • We may change prices. If we do, we will notify you in advance, and you may cancel before the new price takes effect. Price changes never apply to an order already placed.

4. Shipping and delivery

We ship across the EU and to selected non-EU destinations (currently the UK, Switzerland, and Norway). Delivery times are estimates given at checkout and are not guaranteed. Risk of loss or damage passes to you when the product is delivered to the address you provide. Full details are in our [Shipping & Delivery Policy].

5. Returns and your right to cancel

(a) Your statutory 14-day right of withdrawal. If you are a consumer in the EU, you have a statutory right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason, under the EU Consumer Rights Directive and the Bulgarian Consumer Protection Act (Закон за защита на потребителите). To withdraw, tell us within 14 days — by email to contacts@mydailypocket.com or using the model withdrawal form in the Annex. Return the goods within 14 days of telling us. We refund you within 14 days of receiving the goods back (or proof you sent them), to your original payment method.

Exception for opened supplements: for health and hygiene reasons, this statutory right does not apply to supplement pouches that have been unsealed or opened after delivery (Art. 16(e) of the Consumer Rights Directive). Sealed, unopened pouches can be returned under this right.

(b) Our additional 30-day goodwill return. On top of your statutory rights, we voluntarily accept returns of sealed, unopened pouches within 30 days of delivery for a refund of the product price (excluding original shipping costs). You pay the cost of returning the goods. To use this, contact us at contacts@mydailypocket.com. This goodwill window is in addition to — and does not reduce — your statutory 14-day right above. We cannot accept returns of opened or used products under this goodwill policy, for hygiene reasons.

(c) Refunds under (a) or (b) are issued once we receive and inspect the returned goods. Full details are in our [Returns & Refunds Policy].

6. Faulty or non-conforming goods

Nothing in these Terms affects your statutory rights. If a product is faulty, damaged, or not as described, you are entitled to a repair, replacement, price reduction, or refund as provided by EU and Bulgarian consumer law. Contact us at contacts@mydailypocket.com.

7. Health disclaimer

  • MyDailyPocket products are food supplements, not medicines.
  • They are intended to support — not replace — a varied, balanced diet and a healthy lifestyle.
  • They are not intended to diagnose, treat, cure, or prevent any disease, and nothing on our Site is medical advice.
  • Always consult a doctor or qualified health professional before starting any supplement, especially if you are pregnant or breastfeeding, have a medical condition, take medication, or are giving the product to a child.
  • Do not exceed the recommended daily dose. Results vary between individuals.
  • Keep out of the reach of young children and store as directed.

8. Regulatory and product compliance

  • Our products are notified to the Bulgarian Food Safety Agency (BABH) and are placed on the market as compliant food supplements.
  • They are manufactured in an EU GMP-certified facility within the European Union.
  • They follow EU food-supplement rules, use ingredients permitted under EU/EFSA guidance, and meet EU labelling and safety standards.
  • Each product is independently lab-tested, with Certificates of Analysis available on request.

We make every effort to keep product descriptions, ingredients, and nutritional information accurate; minor variations may occur due to recipe or production updates.

9. Intellectual property

All content on the Site — including the MyDailyPocket name and logo, text, images, icons, and designs — is owned by or licensed to Elyvita Ltd and protected by intellectual property law. You may not reproduce, distribute, or use it without our prior written consent.

10. Limitation of liability

To the maximum extent permitted by law, Elyvita Ltd is not liable for indirect, incidental, or consequential losses arising from use of the Site or products. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence or by a defective product, for fraud, or for any other liability that cannot be excluded under Bulgarian or EU law. Your statutory consumer rights are not affected.

11. Indemnity

You agree to be responsible for losses we suffer arising from your breach of these Terms or your unlawful misuse of the Site, to the extent permitted by law. This does not apply to anything caused by our own fault or to your ordinary, proper use of our products and the Site as a consumer.

12. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control — including natural disasters, war, strikes, supply or transport failures, outages, or government action. We will take reasonable steps to limit the impact and resume as soon as possible.

13. Privacy

We handle your personal data in line with our [Privacy Policy], which forms part of these Terms.

14. Governing law and disputes

These Terms are governed by Bulgarian law. As a consumer, you also keep the protection of any mandatory consumer-law rules of the country where you live, and you may bring proceedings in the courts of your own country of residence as well as in Bulgaria. Nothing here removes your right to access mandatory consumer protections.

Resolving disputes: please contact us first at contacts@mydailypocket.com so we can try to resolve the matter directly. If we cannot, you may use an alternative dispute resolution (ADR) body in your country. The European Commission's online dispute resolution platform previously available at ec.europa.eu/consumers/odr was discontinued in 2025; we will direct you to the relevant ADR scheme on request. 15. Notices and changes

We may update these Terms; the version in force is the one published on the Site at the time of your order, shown by the "Last updated" date. If we change them materially, we will give reasonable notice. Notices to you will be sent to the email associated with your account.

16. General

  • Severability: if any clause is found unenforceable, the rest remain in force.
  • Entire agreement: these Terms, with our Privacy Policy and the policies they reference, are the whole agreement between us for your purchase.
  • Assignment: you may not transfer your rights under these Terms without our consent; we may assign ours where your rights are not reduced.
  • Language: these Terms are published in English; if we provide a Bulgarian version and there is a conflict, please contact us — for consumers, mandatory local-language and consumer rules prevail.
